Communications Authority Press Release (December)

This press release summarises the Communications Authority (“CA”)’s decisions following its 37th meeting in December 2014:

Breach of General Condition 12.1 of the Unified Carrier Licence by Hong Kong Telecommunications (HKT) Limited (“HKT”) and Genius Brand Limited (“GBL”)

Following an investigation into a complaint lodged by a member of the public in February 2014, the Office of the Communications Authority ("OFCA") found that HKT and GBL had operated radio base stations without the prior approval of the CA. Having considered the findings of OFCA and the representations made by HKT and GBL, the CA was of the view that HKT and GBL had failed to comply with General Condition 12.1 of their Unified Carrier Licences. The CA decided that a financial penalty should be imposed on each of the licensees, and the amount at HK$ 90,000 each was proportionate and reasonable in relation to their breach concerned. Hutchison Global Communications Limited (“HGC”) was Found not in Breach of Section 7M of the Telecommunications Ordinance (Cap.106) (“TO”)

The CA considered a consumer complaint alleging that HGC had engaged in misleading or deceptive representations as its salesperson promised a waiver of service charges for four months in promoting to her residential broadband service in May 2012, but the promise was not fulfilled by HGC, thereby contravening section 7M of the TO. Having considered the findings of the investigation conducted by OFCA, the CA was of the view that a breach under section 7M of the TO on the part of HGC was not established.
